Data Access and Data Sharing Policy

 

  1. Introduction

At LK Systems, we value your privacy and your ability to access the data generated when you use our connected products and associated digital services.

This policy describes how we handle your right to product and user data in accordance with the EU Data Act (Regulation (EU) 2023/2854), which becomes applicable as of 12 September 2025.

The policy applies to data generated through the use of our connected products and related digital services, such as CubicSecure, CubicDetector, LK Arc and the MyLK app.

 

  1. Scope

This policy applies to you if you:

  • use LK Systems’ connected products and services
  • have an account in any of our digital services (e.g. via MyLK)
  • own a product that generates data storage with LK Systems when used in connected mode

 

  1. What data is covered

Data that may be generated through the use of our products may include, for example:

  • sensor data (e.g. temperature, alarms and operating status)
  • system and log data
  • settings and usage history
  • metadata related to product usage

Personal data is also processed in accordance with our Privacy Policy and the General Data Protection Regulation (GDPR).

 

  1. Your rights under the Data Act

Under the Data Act, you have the right to:

  • request access to your data in a structured, commonly used and machine-readable format (e.g. JSON or CSV)
  • request that your data be made available to a third party in accordance with your instructions, where technically feasible
  • access your data without undue delay and at no unreasonable cost

 

  1. How to request access to data

You can request access to your data by contacting us using the contact details provided in section 11, as well as via the Data Access function in the MyLK app.

To enable us to process your request, we may need you to specify:

  • which product the data request concerns
  • the time period the request relates to
  • whether you want the data to be delivered to you or transferred to a third party

  1. Format and delivery

We provide data in a structured and machine-readable format, typically JSON or CSV.

Delivery may take place via:

  • secure download link
  • encrypted file via email
  • direct transfer to a third party in accordance with your instructions, where technically feasible

 

  1. Security

For security reasons, we may request identity verification before providing data. We use technical and organisational security measures to protect data against unauthorised access, loss and misuse.

 

  1. Limitations

Access to data may in certain cases be restricted, for example if:

  • it would compromise security or technical safeguards
  • the request includes trade secrets or other protected information
  • the provision of data would conflict with other applicable legislation

This policy does not cover source code, firmware or internal business processes.

 

  1. Interaction with the GDPR

The Data Act covers both personal and non-personal data. Where the data includes personal data, it is processed in accordance with the GDPR and our Privacy Policy.

 

  1. Changes to the policy

We may update this policy as needed, for example in the event of changes in legislation or changes to our products and services. The latest version is always available on our website.
